Access is granted on a revocable, non-exclusive, non-transferable basis. Pookie Studios reserves the right to withdraw, amend, or restrict services at any time without prior notice.

You must be at least 13 years of age to use this Website. Users under 18 must have parental or guardian consent. By using the site, you confirm you meet this requirement.

You are solely responsible for all activity conducted under your account, including any access granted to third parties through your credentials.

Prohibited uses include: violating any applicable law or regulation; transmitting spam, malware, or harmful code; attempting to gain unauthorized access to any system; impersonating any person or entity; scraping, crawling, or harvesting data without written permission.

Pookie Studios may terminate your access immediately and without notice for any violation of these Terms.

We reserve the right to modify these Terms at any time. Continued use of the Website following notice of changes constitutes acceptance.

Account Data: When you register, we collect your email address, username, and password hash. This is required to provide you access to the platform.

Usage & Interaction Data: We collect IP addresses, browser type, device identifiers, pages visited, AI prompts, chat histories, and interaction logs for security, analytics, and service improvement.

Payment Data: Payment information is processed by Razorpay (India) and other secure third-party processors. We store only transaction references — never raw card details.

AI Conversations: Your chat messages with Pookie AI are stored in our database linked to your account. These may be reviewed by administrators for safety, quality assurance, and abuse prevention.

Third-Party Services: We use Supabase (data storage and authentication), GoDaddy (domain services), Google Fonts, and our private VPS provider. Each has its own privacy policy.

Data Retention: Account data is retained while your account is active. Upon deletion request, data is removed within 30 days except where retention is legally required.

You have the right to: access your data; request correction or deletion; withdraw consent; lodge a complaint with the relevant data protection authority (in India: MEITY; in the EU: your national DPA).

Strictly Necessary Cookies: Required for authentication (session tokens, Supabase auth), security (CSRF protection), and core functionality. Cannot be disabled.

Performance & Analytics Cookies: Used to measure traffic, page performance, and user flows. Data is anonymized where possible.

Functional Cookies: Store your preferences such as theme, temperature settings, AI engine selections, and notification preferences across sessions.

Third-Party Cookies: Services like Google Fonts and analytics tools may set their own cookies governed by their respective policies.

You can control non-essential cookies through our cookie banner or your browser settings. Disabling cookies may break certain features including login.

We do not sell your cookie data to advertisers or data brokers.

Lawful Basis: Most processing is based on contract (providing you the service you signed up for) or legitimate interest (security, fraud prevention, analytics).

Data Minimisation: We only collect data that is directly necessary for the stated purpose.

Security Measures: All data in transit is encrypted via TLS 1.3. Data at rest in Supabase is encrypted. Access is restricted to authorized personnel only.

Data Breach Response: In the event of a breach affecting your personal data, we will notify the relevant supervisory authority within 72 hours and affected users without undue delay.

International Transfers: Your data may be processed by Supabase (USA) and our private VPS hosting provider. Standard safeguards are maintained for cross-border transfers.

Your Rights (GDPR/DPDP): Right of access, rectification, erasure ('right to be forgotten'), restriction of processing, data portability, and objection. Submit requests to: privacy@pookiestudios.in.

Consent Withdrawal: Where processing is consent-based, you may withdraw at any time through account settings or by emailing us. Withdrawal does not affect prior lawful processing.

Payment Processing: Payments are processed via Razorpay (for India-based transactions) and Stripe (for international). We do not store full card numbers, CVVs, or bank credentials.

Pricing: All prices are displayed in INR or USD as applicable. Prices are exclusive of applicable taxes (GST in India). Tax will be shown at checkout.

Subscriptions: Where subscription plans are offered, you authorize recurring billing until cancelled. Cancellations take effect at the end of the current billing period.

Pre-Orders: Pre-order payments are collected in advance. Delivery timelines are estimates. If a product is cancelled, a full refund is issued.

Refund Policy: Refunds for premium AI access are not available once the service has been used. Refunds for custom project work are governed by the individual project contract. Pre-orders cancelled by Pookie Studios are fully refunded.

Disputes: Payment disputes must be raised within 30 days of the transaction via support@pookiestudios.in before initiating a chargeback. We handle all disputes in good faith.

Failed Payments: If a payment fails, access to premium features may be suspended. You will be notified and given 7 days to resolve the payment before termination.

Studio-Owned IP: The Pookie AI platform, Studio.Nexus architecture, Synthetic Core system, all proprietary design patterns, and the Pookie Studios brand are exclusively owned by the studio. No license is granted to copy, reproduce, or distribute them.

Client Deliverables: Custom-built assets, code, and designs commissioned by clients are transferred to the client upon receipt of full payment, unless the project agreement specifies otherwise.

Pre-existing IP: Pookie Studios retains full ownership of all tools, libraries, and components created prior to or independently of any client engagement.

User-Generated Content: Content you create using Pookie AI tools belongs to you. By using the service, you grant Pookie Studios a limited license to process, store, and serve that content for the purpose of delivering the service.

Portfolio Rights: Pookie Studios may reference completed client work in its portfolio and marketing materials unless explicitly restricted in writing by the client.

Feedback: Any feedback, suggestions, or ideas you submit may be used by Pookie Studios to improve its products without obligation to compensate or credit you.

No Professional Advice: AI outputs do not constitute legal, medical, financial, psychological, or professional advice. Do not rely on AI output for critical decisions without independent verification.

Usage Limits: Free-tier users are subject to usage quotas. Exceeding these limits will result in service restriction. Premium plans have higher but still finite limits.

Prohibited AI Use: You must not use Pookie AI to generate: content that is illegal in your jurisdiction; sexually explicit content; content targeting, harassing, or threatening individuals; disinformation or deceptive content; malware, exploits, or attack scripts.

AI Training: Your conversations with Pookie AI may be reviewed by Pookie Studios staff for safety, quality assurance, and system improvement. We do not sell your AI conversations to third parties.

Third-Party AI Models: Pookie AI is powered in part by models from Groq, NVIDIA, Moonshot AI, and other providers. Their terms and acceptable use policies also apply.

Rate Limiting & Abuse: Automated or scripted queries that abuse the AI system, attempt to extract training data, or circumvent usage limits will result in immediate account termination and may be reported to relevant authorities.

Disclaimer of Warranties: The AI services are provided 'as is' without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or free from harmful outputs.

Automated Bans: Our system (Guardian) may automatically suspend accounts or IP addresses that exhibit suspicious activity. If you believe you were banned in error, you may appeal via the AI support system.

Zero Tolerance: Intentional attacks against our infrastructure — including DDoS, SQL injection attempts, port scanning, or unauthorized access attempts — will result in permanent bans and may be reported to law enforcement.

Vulnerability Disclosure: If you discover a security vulnerability, please report it responsibly to security@pookiestudios.in. Do not exploit or publicly disclose vulnerabilities before they are remediated.

Security Logs: All access attempts, authentication events, and system interactions are logged and retained for a minimum of 90 days for forensic and security purposes.

Support interactions (tickets, chat, and email) are logged for quality assurance, training, and legal compliance purposes.

You must not use support channels to harass staff or other users, submit false reports, or attempt to manipulate support outcomes through threats or abuse.

Community posts and public content you submit are governed by our Community Guidelines. Violating content will be removed.

Banned users may appeal through designated channels. Appeals are reviewed within 5 business days. False appeals or repeated abuse will result in permanent exclusion.

Responses provided through community channels and AI tools are informational only and do not constitute binding commitments from Pookie Studios.

Governing Law: These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Dispute Resolution: We encourage resolving disputes informally first. Contact legal@pookiestudios.in before initiating formal proceedings. We will respond within 10 business days.

Arbitration: Disputes not resolved informally shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be India.

EU/UK Users: If you are located in the EU or UK, you additionally benefit from mandatory consumer protection laws in your jurisdiction. Nothing in these Terms limits rights you have under applicable local consumer law.

Class Action Waiver: You agree that any claim will be brought individually and not as part of a class or group action.

Limitation of Liability: To the maximum extent permitted by law, Pookie Studios shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of this Website or its services.

Hosting & Infrastructure: The Website is hosted on our private VPS servers. Domain registry and DNS are provided by GoDaddy.

Database: User data, chat histories, and account information are stored in Supabase (PostgreSQL), which operates on AWS infrastructure.

AI Providers: AI inference is powered via Groq (USA), NVIDIA NIM (USA), and Moonshot AI (China). Your AI prompts are transmitted to these providers for processing.

Payments: Razorpay (India) and Stripe (USA/Ireland) handle payment processing. Their respective privacy and security policies apply to payment data.

Analytics: We may use performance monitoring tools. Data is aggregated and anonymized where possible.

Service Outages: Pookie Studios is not liable for service interruptions caused by third-party provider outages. We maintain best-effort uptime and communicate downtime via our status page.
